Right of Withdrawal and Refund
Bicimania di Genovese Gabriele recognizes the right of withdrawal as provided by current legislation. The deadline to exercise this right is 14 days from receipt of the goods. By that date, the customer must send notification via email to ecommerce@biked.it. Returns are the customer's responsibility. To proceed with a return, the following conditions must be met:- The products must be in perfect condition, with no signs of use, washing, or assembly, with their original boxes and/or bags, tags, instructions, and everything else included. They must therefore be in the same condition in which they were purchased. The same applies to bicycles, which, if used, cannot be returned.
- The products are not food or custom-made or personalized items
- The sales document (receipt/invoice/ticket) must be attached
- The returned goods must be packaged in suitable packaging to ensure their integrity during return transport.
Product Change
If the Customer wishes to exchange a product for another, the correct procedure is for the Customer to return the item for a refund (following the return policy described above) and place a new order for the desired item.Defective Product Upon Receipt (Within 14 Days)
If you receive a defective product, please contact us immediately to report the issue. We will evaluate whether the issue can be resolved without returning the item. If a return is necessary, Bicimania di Genovese Gabriele will, in most cases, arrange for the product to be picked up by its own courier. If you are responsible for the return shipping, we recommend low-cost shipping with tracking. Bicimania di Genovese Gabriele is not responsible for merchandise that is not received or damaged during return shipping , and the refund of shipping costs incurred by the customer may have a set maximum (please contact us for more information before shipping). Shipping costs for returning a defective product are the responsibility of the customer only unless otherwise agreed with our customer service. Please always contact us before returning the item.Sending Errors on Our Side
If the wrong item was shipped, please contact us within 48 hours of receiving your package. We will arrange a replacement or collection at our expense.Bulky Products
For returns of bicycles or other bulky items, we recommend that you contact us before proceeding. We can provide helpful packing tips and check whether it's possible to arrange for our courier to pick up your item at a discounted rate.Orders Shipped Not Collected or Refused by the Customer
In the event that the Customer refuses delivery of the package by the courier, or in any case fails to accept or collect it after shipment (including cases of failure to collect it from delivery points or courier depots), the following conditions shall apply to protect the Seller:Refusal with Prior Notice of Withdrawal
If the Customer has previously communicated their intention to withdraw from the purchase contract and subsequently refuses the package or fails to collect it, the refund will be issued only after the package has been received at our warehouses and verified. In this case, both outward and return shipping costs will be deducted in full from the refundable amount , even if the initial shipment was offered free of charge. This deduction is justified by the logistics costs actually incurred for both-way transportation, in accordance with Article 57 of Legislative Decree 206/2005 (Consumer Code), which establishes that the consumer bears the direct cost of returning the goods, implying that, in the event of non-receipt by their choice, the cost of outward and return shipping will be borne by them. To validly exercise the right of withdrawal in this context, the Customer must communicate their decision to us by means of an explicit declaration via email . This communication must be sent before the 14 (fourteen) day withdrawal period expires , which starts from the physical receipt of the goods or from the day on which a third party (other than the carrier and designated by the Customer) acquires physical possession of the goods. In the event of refusal of delivery, the 14-day period starts from the first delivery attempt made by the carrier, as the Customer has had the opportunity to acquire physical possession. The withdrawal notice must be sent to the following email address: ecommerce@biked.it indicating:- Order number
- Customer's Name and Surname
- Explicit declaration
Refusal Without Prior Notice of Withdrawal
If the package is refused or uncollected without the Customer having sent a formal notification of withdrawal via email within the legal deadline (14 days from receipt or the date of the first delivery attempt), Bicimania di Genovese Gabriele reserves the right to withhold all logistics and handling costs incurred from the refundable amount. These costs include, but are not limited to, return shipping costs, storage costs, and administrative fees arising from handling the unauthorized return. This conduct, in fact, does not constitute a valid exercise of the right of withdrawal pursuant to the law and entails unexpected costs and expenses for the Seller. The Customer will be refunded any remaining amount, net of the aforementioned withholdings.Order Placed by Error by Customer
In the event that the Customer declares that they have placed an order in error and the shipment has already been collected by the courier or has been delivered, the situation will be managed according to the following methods, to protect the Seller:
1. Right of Withdrawal. The declaration of an order placed in error by the Customer will be treated as an intent to exercise the right of withdrawal pursuant to Legislative Decree 206/2005 (Consumer Code). To validly exercise this right, the Customer is required to communicate their decision to us via an explicit declaration via email. This communication must be sent within 14 (fourteen) days starting from:
- From the day on which the Customer or a third party, other than the carrier and designated by him, acquires physical possession of the goods.
- In case of refusal of delivery by the Customer, the term starts from the first delivery attempt made by the carrier, as the Customer has had the opportunity to acquire physical possession.
